What is it about?
Notarial acts are public documents where notaries, at the request of one of the parties, record and certify the events and details they witness or know, which are not related to contracts.
These are regulated under Section 4 of Chapter II of Title IV of the Decree of June 2, 1944, which approves the Regulation of the organization and regime of the Notary.
Lastly, it’s important to note that general meeting minutes and strict reference minutes can be requested via videoconference.
Types of Acts
Testimonial Acts: These acts verify statements made by a person and the time they were made.
Presence Acts: The notary is required to verify the state of an asset at a specific location at a particular time, and may take images if necessary.
Claim Acts: The notary is asked to demand something from someone or to carry out a specific act, documenting the request and the response received.
Social Meeting Acts: These document statements, claims, documents, and decisions made at a company meeting.
Acts of Deposition of General Terms and Conditions: The notary records the contractual conditions incorporated by a company in its contracts as evidence that they were valid at a specific time.
Balance Acts: The notary certifies the final balance of an account or debt after performing the necessary calculations.
Contest Acts: The presence of the notary at a contest ensures the integrity of the results and the randomness of the selection.
Protocolization Acts: The notary incorporates legal and legitimate documents into their archive, which is confidential and cannot be altered.
